Terms & Returns Policy

Client accept that the goods are made primarily from wood which is an organic building material and is subject to settlement, splits/cracks, expansion and contraction according to ambient conditions. Unless constructed on a foundation to the supplier’s specification, the supplier has no liability to me for any adverse consequences and effects. The cabin needs to be painted/stained and sealed within 4 weeks of assembly. Any issues resulting from poor quality painting or inadequate sealing, are not covered by the warranty. It is the clients responsibility to maintain and sufficiently ventilate their cabin to prevent mould build up. Mould is not covered by the warranty. Product manufacturing order process will start only after sales agreement is signed. Due to market volatility, timber prices may increase between ordering and delivery, which can increase the overall cost. Should the price increase, the client shall have the choice to pay the increased price or cancel their order and receive a refund.

1. Definitions

The following words shall have the following meaning respectively: the “Sales Order” – the agreement between the Supplier and the Customer to supply the Building; the “Supplier” – My Cabin Scotland LTD trading as My Cabin; the “Customer” – the person who signed the Sales Order; the “Building”- wooden structure as stated on the Sales Order.

2. Price
The price for the Building shall be as set out on the Sales Order. In the events of any alterations subsequent to signing the Sales Order required by the Customer to specifications, quantity, place or date of delivery, the Supplier may vary the price accordingly.

3. Payment
3.1 The deposit of 50% of the price agreed on the Sales Order shall be paid before processing. The deposit is non-refundable. On receipt of the deposit and the signed Sales Order the Supplier will take the steps to supply the goods ordered.
3.2 Any payments on account by the Customer to the Supplier may be set off by the supplier against any liability, costs or expenses incurred by the Supplier in complying with the Sales Order in the event that the Customer should breach the contract. i.e. non payment etc. or any other breaches of contract.
3.3 The deposit of 50% of the price noted on the Sales Order shall be paid with the delivery of the signed Sales Order. This is non-refundable. The other payment modalities may be confirmed on the Sales Order signed by the Supplier. A further instalment of 50% of the price shall be paid before the delivery of the log cabin. The full amount on the sales agreement must be settled before the delivery of the log cabin.
3.4 The Customer shall make all payments in Pound Sterling, without set-off or counterclaim and free and clear of all taxes, deductions, withholdings and other charges.
3.5 Please note all necessary steps will be taken to recover any outstanding sums owed to the Supplier. Legal proceedings will be initiated to the Customer to recover these amounts if they are not forthcoming. Once court judgement is obtained, judgement may be enforced by one of the following methods (a) Seizure of goods (b) Attachment of earnings order (c) Registration of a judgement mortgage over your property.

4. Ownership
4.1 The Building shall remain the property of the Supplier until all sums owed by the Customer to the Supplier are paid. Title to the Building only passes to the Customer when payment is made for them in full.
4.2 The Supplier shall be entitled to repossess any Building supplied to the customer in respect of which payment is overdue and thereafter to re-sell the same. For this purpose, the Customer HEREBY GRANTS an irrevocable right and license to the Supplier or its agents to enter the property where the building is installed for the purpose of repossessing the Building.

5. Delivery
5.1 The delivery date as stated on the Sales Order is intended as an estimate or guide only.
5.2 The Supplier shall be not be liable to the Customer for any third-party loss, damage or alteration directly or indirectly or consequential to any property, undertaking or event caused by or arising from or connected with any delay in delivery of the Building or failing to execute an order or delivery or cancellation of the contract.
5.3 The Customer will allow and/or procure sufficient access to and from the relevant site for the delivery of the Building. The Customer will ensure that the site is cleared and prepared before the delivery is due to commence.
5.4 The Supplier reserves the right for the delivery of the Building to the kerb-side only. In the case where supplier is unable to deliver the goods due to the poor access to the site the Supplier reserves the right to deduct delivery cost from the deposit received and to not return with delivery until access to the site is available.
5.5 Delivery shall be at the Customer’s premises stated on the Sales Order, unless otherwise stated.
5.6 Unless otherwise expressly agreed, the Supplier may make delivery in one or more instalments.
5.7 Risk to the Goods purchased shall pass to the Customer upon delivery (delivery is deemed made when the Goods are made available to the Customer once unloaded at the point of delivery).

6. Warranties
6.1 The Supplier warrants that at the time of sale, it will have title to sell the Building to the Customer.
6.2 The Supplier warrants the fitness for the purpose, suitability and merchantability only of goods supplied by it to the Customer under the Sales Order subject to ordinary reasonable wear and tear for the durations as below from date of practical completion;
• 5 years structural warranty for externally insulated cabins
• 2 years structural warranty for not insulated cabins
• 5 years UPVC Windows & doors
• 2 years wooden painted windows & doors
• 0 years not painted wooden windows & doors
6.3 Relocation of the Building will void any warranty.
6.4 The Supplier shall not be liable for any damage or other adverse consequence to the goods supplied and sold to the customer caused directly or indirectly by any failure or default or neglect on the part of the Customer to properly maintain them and to comply with the Supplier’s maintenance instructions. Changes or alterations to parts or components unless approved or performed by the Supplier or his agents are at the Customer’s risk.
6.5 In the event that the goods are supplied in flat pack, no warranty shall be supplied.

7. Maintenance
7.1 The Supplier requires that the Building be sealed with external silicone sealant (on roof & skirt lines, around window & door frames and all vertical joints ) after 2 to 3 coats of painting or staining (not varnish or clear stain) with a suitable quality wood treatment, in accordance with the application instructions for the product. This needs to happen within 4 weeks of final completion of the Building and thereafter according to the recommendations of the product manufacturer and the Supplier. Any issues resulting from poor quality painting or inadequate sealing, are not covered by the warranty.
7.2 The Supplier requires that the Building be suitably ventilated, and humidity controlled to prevent the development of mildew or mould, these are not covered by the warranty.

8. Authorities
8.1 It is the Customer’s responsibility to obtain all permissions and consents, including all local authority planning permissions or any certificates or authorizations under any bye-laws or building regulations if applicable.
8.2 Where the Customer authorizes access through adjacent properties for the Supplier’s use during delivery and or installation, the Customer is required to obtain permission from the owners of the adjacent property for such use and the Customer agrees to be responsible and accept the risk and liability thereof and to indemnify the Supplier against any loss arising from the use thereof.

9. Additional Works
9.1 The Supplier shall provide any extra works required in line with Supplier’s specifications appropriate to the goods purchased by the Customer at the extra price agreed.
9.2 If extra works such as electricals and/or plumbing are undertaken by third parties which are not to the Supplier’s specifications, the Supplier will not be responsible for any damage or alterations done during or any loss caused by fittings of electricals and/or plumbing, the Supplier does not guarantee such work.
9.3 If a base or foundation is ordered, the Supplier shall provide a base suitable for the size of the Building and guarantee such work. If the Customer does not require a base or foundation from the Supplier, the Customer accepts that any base constructed by the third party is a matter between the third party and the Customer and holds the Supplier free from liability for any adverse consequence arising. In particular, if the base is not built to the specifications of the Supplier, the Supplier will not be responsible for defects caused to the goods supplied and the Building by the third-party foundation.

10. Courtesy
10.1 Referrals to third party contractors by the Supplier to the Customer are given as a professional courtesy only. The Supplier is not responsible for any subsequent conduct or services provided by third party contractors.

11. Returns
11.1 The Supplier does not accept any returns save in accordance with the Customer’s statutory rights.

12. Lead Time
12.1 Supplier indicated lead times are for guidance only and may increase during busy periods or in circumstances outside of our control.

13. Cabin Storage
13.1 The Customer will be notified within approximately one week before the Building is delivered to the Supplier’s warehouse. It is the Customer’s responsibility to have the site ready for the Building to be delivered within one week from the notification. The Buildings can be stored for the delayed delivery for an additional charge of £100 per week for Buildings under 25 sq. meters and £150 for Buildings over 25 sq. meters.

14. Foundation Pricing
14.1 If the Customer has purchased the timber frame and block pad foundation services from the Supplier the Customer guarantees that the site is level and stable. If upon installation it appears otherwise the Customer may be liable for extra charge of £15 per sq. meter for foundation works or refusal of foundation works and the Customer may be required to organize the foundation themselves.

15. Insulation
15.1 Please note that the final clearance dimensions can change when we internally insulate the exterior walls thus reducing the overall internal area. It is best to measure after installation completion.

16. Product finishing
16.1 All Buildings are pre-finished products. Sanding, filling, painting and sealing may be required.

17. Queries and Complaints
17.1 Notification of queries and/or complaints must be notified to the Supplier in writing within fourteen (14) days of receipt of the Building. We will aim to reply within 40 days of receipt of the complaint after investigations are made, and if further investigations need to be made after this time, we will notify you in writing.

18. VAT
18.1 Unless expressly quoted as including VAT, all prices are exclusive of value added tax or any other government taxes or duties which, if applicable, shall be paid by the Customer.

19. Remedy
19.1 Subject to Clause 22, if the Supplier is in breach of the warranties given by it under Clause 6, its liability shall be limited to:
a) replacement of the Building concerned; or
b) at the option of the Supplier, reimbursement of the price.

20. No Other Liability
20.1 Subject to Clause 22, the Supplier shall have no further liability to the Customer other than as described in Clause 19, whether under these conditions of sale or on any other basis including liability in tort as a result of the sale of the Building and other goods supplied.

21. Consequential Loss Etc.
21.1 Subject to Clause 23, the Supplier shall not under any circumstances be liable to the Customer by reason of any representation or warranty, condition or other term or any duty of common law, or under the express terms of these conditions of sale, for any consequential, special, incidental or punitive loss or damage (whether for loss of current or future profits, loss of enterprise value or otherwise) and whether occasioned by the negligence of the Supplier, its employees or agents or otherwise, even if advised of the possibility of such damages.

22. Non-excludable Liability
22.1 Nothing in this these conditions of sale shall exclude or limit the liability of the Supplier for death or personal injury resulting from the negligence of the Supplier or any of its employees or agents, nor shall they operate to exclude or limit any statutory rights which cannot be legally excluded or limited, including the statutory rights of a Customer.

23. Application
23.1 These conditions of sale shall apply to any purchase of goods under an order which is accepted by the Supplier. No other terms shall apply to the sale of the goods, including any standard conditions of purchase of the Customer, even if they are printed on the written order of the Customer or any other document issued by the Customer.

24. Governing Law
24.1 These conditions of sale shall be governed by Scottish law.

25. FORCE MAJEURE. Neither Party will be liable for any failure or delay in performing an obligation under this Agreement that is due to any of the following causes, to the extent beyond its reasonable control: acts of God, accident, riots, war, terrorist act, epidemic, pandemic, quarantine, civil commotion, breakdown of communication facilities, breakdown of web host, breakdown of internet service provider, natural catastrophes, governmental acts or omissions, changes in laws or regulations, national strikes, fire, explosion, generalized lack of availability of raw materials or energy.
